Nevada Rules

Observation & Recording at IMEs

NRS 52.380 was repealed in 2023. Current rules are governed by NRCP 35 and applicable court procedure.

NRS 52.380 — Repealed

Nevada's prior statute governing IME recordings was repealed in 2023. Attorneys relying on its provisions should note this change. Current authority derives from NRCP 35 and court procedure.

Observers

  • Attorneys, adjusters, or representatives may observe
  • Advance written authorization required
  • Observers must remain non-participatory and unobtrusive
  • No coaching, interruptions, or participation permitted

Recording

  • Permitted only via stipulation or court order
  • Authorization must be provided at time of scheduling
  • Courts may issue protective orders in cases of disagreement

Scheduling Guidance

Provide written authorization or relevant court orders when scheduling. Requests submitted without authorization may delay examination scheduling.

Standards

Which AMA Guides Edition Applies?

Nevada Workers' Compensation

AMA Guides — 5th Edition

Nevada's adopted standard for workers' compensation impairment ratings. Uses diagnosis-based impairment methods with range-of-motion and DRE models. Produces percentage impairment values used for PPD determinations.

When Specifically Requested

AMA Guides — 6th Edition

Utilizes ICF-based functional grids and pain rules. Typically produces lower percentage impairment values than the 5th Edition. Available upon request — a crosswalk comparison explaining the difference in methodology and result is included.

All reports specify which edition was applied and why. When an alternate edition is requested, the report includes a crosswalk explanation so adjusters, counsel, and judges can compare results across methodologies.

Testimony

Deposition & Trial Testimony

Dr. Korzeniowski is available for deposition and courtroom testimony on all rendered opinions. Reports are prepared with scrutiny in mind from the first page — findings are documented, methodology is transparent, and conclusions are supported by cited evidence.
