NRS 52.380 Repeal & IME Observation/Recording – What Attorneys Should Know

  • Repeal: NRS 52.380 (regarding IME recordings/observers) was repealed in 2023. Current rules come from NRCP 35 and court procedure.
  • Authorization Required: Observation or recording requires advance written notice and proper authorization or court order.
  • Observers: Attorneys, adjusters, or representatives may observe if non-participatory and non-disruptive.
  • Recording: Permitted only with authorization (stipulation or order).
  • Disputes: Courts may issue protective orders if disagreements arise.
  • Scheduling Tip: Please provide written authorization or the relevant court order at the time of scheduling.
  • Impairment Ratings: Nevada uses the AMA Guides, 5th Edition for state impairment ratings.
    • The 6th Edition differs (ICF-based grids, pain rules, typically lower percentages).
    • If another edition is requested, ask the evaluator for a crosswalk/explanation to maintain clarity.
  • Commitment: I welcome attorney/adjuster observation when permitted and strive to ensure fairness, transparency, and exam integrity within Nevada law.
  • Evaluation-only practice — explicit separation from treatment.
